Class action lawsuit: Canon printers falsely marketed as multifunctional devices

BROOKLYN, N.Y. (Legal Newsline) — Canon is facing a class action over its "All In One Printers" alleging that they are falsely marketed as multifunctional devices. 

Christopher Bozyk, individually and on behalf of all others similarly situated, filed a complaint Aug. 31 in the U.S. District Court for the Eastern District of New York against Canon USA Inc., alleging violation of Massachusetts' Unfair and Deceptive Business Practices Act and other claims. 

Bozyk alleges in his class action that Canon's "All in-One Printers" are falsely being marketed as multifunction devices that can print, copy and scan, as well as fax on some models. He claims the printers are advertised as having three or four functions when the printers can not scan or fax documents when the devices have low or empty ink cartridges. 

Bozyk says Canon's advertising claims are misleading and deceive consumers because the product's functions are restricted. He claims Canon fails to warn consumers about the ink as a "necessary component" in order to fax or scan and that buyers are faced with the expense of ink cartridge purchases. 

He further claims no ink is used to fax or scan documents and that Canon knew this defect would disable the printers. Bozyk alleges Canon has received complaints since at least 2015 regarding the scanners not functioning when ink is low.  

Bozyk and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Neal Deckant of Bursor & Fisher PA in Walnut Creek, California.
