Delivery driver sues Marriott in Tampa after abduction, sexual assault

TAMPA, Fla. (Legal Newsline) — A food delivery driver claims a lack of security at a Residence Inn by Marriott in Tampa, Fla., led to her to abduction and sexual assault.  

Jane Doe filed a complaint July 24 in Hillsborough County Circuit Court against Starwood Capital Group Holdings, doing business as Residence Inn, and others, alleging negligence.

Doe, according to her complaint, was a food delivery driver dropping off food at the Residence Inn by Marriott in Tampa. She claims she was directed to an unsecured area of the hotel where she was required to meet the customer. 

She claims that while waiting, a man entered her vehicle, abducted her and forced her at gunpoint to drive to an apartment complex alley where she was sexually assaulted. Doe alleges the defendants' negligence for failing to have adequate security at the hotel, including police or security guard patrol. She also alleges the defendants did not have an adequate overall security plan or sufficient number of guards in visible areas to deter crime. 

Doe claims the defendants failed to properly train security guards to protect hotel residents, invitees and the public. 

Doe seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She s represented by Kimberly Wald and Michael Haggard of The Haggard Law Firm PA in Coral Gables.
