JACKSONVILLE, Fla. (Legal Newsline) — A consumer alleges Target falsely labels its Market Pantry-brand water enhancer as containing only natural flavorings.
Erica Broddie, individually and on behalf of all others similarly situated, filed a complaint Aug. 14 in the U.S. Bankruptcy Court for the Middle District of Florida against Target Corporation, alleging violation of Florida's Deceptive and Unfair Trade Practices Act and other claims.
According to Broddie's class action, Target claims its Market Pantry brand water enhancer gets its taste only from natural flavoring ingredients. She alleges she expected the product's berry and pomegranate taste was from berries such as blueberry and raspberry and not artificial flavoring. Broddie further claims the product's labeling states "Natural Flavor With Other Natural Flavors."
She alleges malic acid is listed as the third ingredient, which is artificial and that consumers would not have paid more for the product had they known the representations were false and misleading. She also claims Target omitted the required "artificially flavored" disclosure from the product's front label and failed to identify the source of the water enhancer's berry pomegranate flavor.
Broddie and the class seeks monetary relief, interest, trial by jury and all other just relief. They are represented by William Wright of The Wright Law Office PA in West Palm Beach and Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
