BOSTON (Legal Newsline) — A Boston area attorney is facing a lawsuit after he allegedly failed to disclose to clients he resigned his license to practice law due to facing disciplinary sanctions from the Massachusetts Bar.
Bryan Stewart filed a complaint July 14 in Suffolk County Superior Court against James Tewhey, alleging negligence, breach of contract and other claims.
According to his complaint, Stewart began working for the Massachusetts Bay Transportation Authority in January of 2005, and was a member of the Boston Carmen's Union Local 589. He alleges that in November of 2020, he hired Tewhey for an arbitration matter with the Local 589 and paid Tewhey a $800 retainer.
He alleges he again hired Tewhey in December of 2021 and paid an additional $750 retainer to Tewhey for another Union legal matter and claims that during that time, Tewhey resigned his license to practice law due to facing disciplinary sanctions from the Massachusetts Board of Bar Overseers and failed to disclose to him or other clients his resignation.
Stewart claims that due to Tewhey's failure to file court documents and do other work on his case, the deadline for his appeal with the Local 589 passed and his termination from his job became final.
Stewart seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. He is represented by Sean Cronin of Cronin Law PC in East Boston.
