LOS ANGELES (Legal Newsline) — Aldi is facing a class action lawsuit over alleged mislabeling of its flavored drink enhancers.
Erin Farmer, individually and on behalf of all others similarly situated, filed a complaint in the U.S. District Court for the Central District of California against Aldi Inc., alleging violation of Florida's Deceptive and Unfair Trade Practices Act, fraud and other claims.
Farmer alleges in her class action that Aldi's strawberry and watermelon flavored drink enhancers' label omits the added artificial flavoring in the product. She claims the product label states "Natural Flavor With Other Natural Flavors" with a picture of fresh watermelon and ripe strawberry and leads consumers to expect its taste is not from artificial flavoring ingredients.
Farmer further claims the fine print on the back of the product label lists "malic acid" as the third ingredient and uses "DL-Malic acid" with sugars, which is not equivalent to the natural flavors from watermelon and strawberries and is not a "natural flavor." She alleges consumers are unaware the product contains artificial flavoring ingredients and is not disclosed on the front label and is false and misleading advertising.
Farmer and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by William Wright of The Wright Law Office PA in West Palm Beach, Florida, and Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York.
