Lawsuit: Switched plates at Disney World restaurant sent woman into anaphylactic shock

ORLANDO, Fla. (Legal Newsline) — A woman alleges she went into anaphylactic shock at a Disney World restaurant after negligently being served a meal containing peppers, despite her notifying them of her food allergy.

Gabrielle Cash and Faiyaz Kara filed a complaint June 15 in Florida's Orange County Superior Court against Walt Disney Parks and Resorts Inc., alleging negligence and other claims. 

According to their complaint, the plaintiffs dined at the Victoria & Albert's restaurant located at Disney's Grand Floridian Resort & Spa on March 25. They allege that prior to dining at the restaurant, they made reservations and informed the restaurant that Gabrielle Cash had a severe allergy to capsaicin, a component of chili peppers. 

The plaintiffs further allege that after being seated at the restaurant, they informed the server of her allergy and were assured she would be accommodated. They claim that during their dinner, the meal prepared without peppers was given to her dining companion and she was served the dish with peppers, which caused her to go into anaphylactic shock. The plaintiffs further claim Cash was sent by ambulance to the hospital and treated for the severe allergic reaction. 

They allege Disney negligently served Cash the meal containing peppers after being assured by the server it contained no peppers. 

The plaintiffs seeks monetary relief of more than $50,000, interest and all other just relief. They are represented by Dominick Patrick and Alexis Cooper Patrick of The Patrick Legal Group PA in Orlando.
