SAN FRANCISCO (Legal Newsline) - Class action lawyers say they have proof Beautyrest's 1,000-thread-count bedding is actually of worse quality than it claims to be.
Plaintiff Loriann Staples sued Simmons Bedding Company May 17 in California federal court. She's represented by attorneys at Bursor & Fisher in Walnut Creek.
Their lawsuit says independent testing has revealed that the thread count on bedding and linen is actually only 216.
"Defendant's false and misleading representations of the Beautyrest Products are reasonably likely to deceive the public," the lawsuit says. "The false and misleading representation of the thread count deceives and misleads consumers into believing that they are purchasing a product which is of higher quality, durability, longevity, softness or better for sleeping than products with a lower thread count."
The suit says Staples purchased bed sheets that promised a 1,000 thread count, but that Simmons Bedding has departed from the industry standard for measuring thread count by "counting plied yarns individually."
This can double or triple the thread count. The Federal Trade Commission has said this practice can create confusion in the marketplace, the lawsuit says.
"The practice of counting the plies that make up each thread was also condemned by the American Textile Manufacturer's Institute," the lawsuit says.
