LAS VEGAS (Legal Newsline) — A patron alleges the Bellagio Casino illegally confiscated his gambling chips and illegally issued a trespass warning.
Theodore Lichtenstein III filed a complaint April 24 in the U.S. District Court for the District of Nevada against Bellagio LLC doing business as Bellagio Hotel & Casino and MGM Resorts International.
According to Lichtenstein's complaint, he is an "advantage gambler" and earned $20,200 in casino chips while gambling at the Bellagio Casino. He claims the chips were earned at gaming tables and by purchasing them at the cage or tables at the casino.
Lichtenstein further alleges when he attempted to redeem the chips on Aug. 15, 2021, Bellagio personnel took possession of the chips and neither redeemed nor returned them to him and illegally confiscated the chips. He also alleges the defendant issues a trespass warning barring him from casinos/hotels and fraudulently sought to intimidate him with the warning that went beyond the borders of Nevada and at casinos or properties they neither own or operate in violation of Nevada state law.
Lichtenstein seeks monetary relief of more than $75,000, interest, trial by jury and all other just relief. He is represented by Robert Nersesian in Las Vegas, Nevada.
