Lawsuit: Expired mac and cheese from Dollar General caused food poisoning

HELENA, Ark. (Legal Newsline) — A man alleges he got food poisoning from an expired macaroni and cheese product he purchased from a Dollar General in Arkansas. 

Lenny Newsom filed a complaint April 21 in Phillips County Circuit Court against Dolgencorp LLC, doing business as Dollar General, alleging negligence.

Newsom, according to his complaint, was at the Dollar General store in Lexa on March 7, 2023. He claims that shortly after eating Kraft Deluxe Macaroni & Cheese that he purchased from the store, he became nauseous and had vomiting, diarrhea, fever and stomach pain. Newson alleges the macaroni and cheese product was expired and claims Dollar General's negligence for selling the expired food product.  

He claims the food was not fit and safe for human consumption and that Dollar General breached its warranty of merchantability, which caused his injuries. Newsom alleges he incurred medical expenses of $6,364.95 due to his illness. 

Newsom seeks monetary relief of less than $74,000, interest, trial by jury and all other just relief. He is represented by Keith Clements of the Etoch Law Firm in Helena.
