WHITE PLAINS, N.Y (Legal Newsline) — A New York-based international law firm is facing a class action over a 2022 data breach.
Patrick Perotti, individually and on behalf of all other similarly situated, filed a complaint April 1 in the U.S. District Court for the Southern District of New York against Cadwalader, Wickersham & Taft LLP alleging negligence, unjust enrichment and other claims.
Perotti alleges in his class action that the defendant, a New York-based international law firm, has been involved with several matters that require the collection of individuals' Personal Identifying Information (PII) for "shareholder derivative suits." According to the suit, in November of 2022, "an unauthorized third party" gained access to the plaintiffs' PII through a remote data breach that included names, Social Security numbers and shareholder information.
Perotti claims that about 93,211 individuals were affected by the data breach, which has put them at risk of credit fraud and identity fraud. The plaintiff also claims the data breach has caused him "irreparable damage" like hours and money spent having to monitor his accounts and the cancellation of credit cards. He alleges the defendant's negligence for failing to maintain a secure firewall and for not monitoring suspicious or irregular traffic to its servers.
Perotti and the class seek monetary relief, interest, trial by jury and all other just relief.
