ORLANDO, Fla. (Legal Newsline) — The parents of a Florida minor who suffered damage to his eye from a Lightsaber toy is claiming Disney's negligence.
Veronica Mendez and Louis J. Gemma, as parents and natural guardians of L.G., a minor, filed a complaint March 23 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S., Inc., alleging liability, negligence and other claims.
According to the plaintiffs' complaint, their son L.G., was at a friend's house on June 5, 2022, in Punta Gorda and was playing with "lightsaber toys." They claim the lightsaber toy L.G., was playing with was purchased from the Walt Disney theme park. The plaintiffs allege that L.G., was struck in the eye by the lightsaber's blade and suffered severe and permanent injuries.
They claim the lightsaber sold by Disney was defective and unreasonably dangerous and did not have mechanisms to prevent or minimize the point of the blade from causing harm. They also claim Disney failed to warn of the hazard or have adequate instructions. The plaintiffs allege Disney's negligence for manufacturing and selling the lightsaber which presents a danger to the public and should have know the toy would be used without inspection.
The plaintiffs seek monetary relief of more than $50,000, interest, trial by jury and all other just relief. They are represented by Shane Newlands of Newlands & Clark in Lakewood Ranch, Florida.
