Suit: Lack of proper pedestrian detour caused UMass student's death

BOSTON (Legal Newsline) — The parents of a University of Massachusetts student who was fatally struck by a vehicle alleges a closed sidewalk at a construction site and a negligent driver caused her death.  

Peter Lucore and Laura Lucore, as administrators of the Estate of Elena Lucore, filed a complaint Feb. 15 in Suffolk Superior Court against Joseph Weissler and Suffolk Construction Company Inc., alleging negligence, wrongful death and other claims. 

According to the Lucores' complaint, their daughter Elena, who was 19 years old at the time, was a student at the University of Massachusetts-Amherst in Hampshire County. They claim their daughter was walking on Massachusetts Avenue on Feb. 22, 2022, and due to construction, was forced to walk on the roadway because of a closed sidewalk. 

The plaintiffs claim that Weissler was driving his vehicle on Massachusetts Avenue at the same time when he struck and killed their daughter. They claim Weissler was speeding and failed to observe their daughter on the roadway. They also claim Suffolk's negligence for failing to have warning signs that the pedestrian walk was closed or a detour for pedestrians. 

The plaintiffs further claim Suffolk knew the construction project was in the area with a high number of students who traverse on foot in a major thoroughfare and negligently failed to provide safe pedestrian access along the construction site. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Jeffrey Glassman, Michael D'Isola and Jeffrey Glassman of of Jeffrey Glassman Injury Lawyers in Boston.
