Estate of man dragged to death at Boston subway station files lawsuit

BOSTON (Legal Newsline) — The estate of a man who was dragged to his death by subway car in Boston is claiming negligence. 

Christopher Lalin and Kelvin Lalin, co-personal representatives of the Estate of Robinson Lalin Guity, filed a complaint in Suffolk Superior Court against Massachusetts Bay Transportation Authority alleging negligence and other claims. 

According to the plaintiffs' complaint, Guity was at the Broadway MBGTA Station in Boston on April 10, 2022. They claim Guity's arm became trapped in the doors of the subway car he was exiting which caused him to be dragged to his death. 

The plaintiffs further claim Guity's body was damaged and dismembered and that he suffered conscious pain and suffering prior to this death. They allege the subway operator failed to confirm the platform and subway doors were clear before pulling the train away in violation of MBTA policies and procedures. 

They also allege the defendants failed to inspect, maintain and monitor the subway cars and station, including the door and alarm systems. The plaintiffs claim the defendants failed to timely replace and upgrade the subway cars and take the unsafe cars out of service so that the trains were safe for use by the public. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Michael Mahoney and Ryan Gilday of The Law Offices of Michael F. Mahoney in Lynn and Benjamin Zimmerman and Stacey Pietrowicz of Sugarman and Sugarman PC in Boston.
