Dunkin Donuts owner sued as man says coffee sent him into anaphylactic shock

BOSTON (Legal Newsline) — A Massachusetts man alleges he suffered anaphylactic shock due to nut allergens in a cup of Dunkin Donuts coffee. 

Jameson Fernandez filed a Feb. 21 in Suffolk Superior Court against Panzini Donuts Inc., alleging breach of implied warranty and other claims. 

According to his complaint, Fernandez ordered a French vanilla decaf coffee from the defendant's Dunkin Donuts in Chelsea on Feb. 28, 2020. He claims he informed the defendant's employees about his severe nut allergy and was assured there were no nut products in the coffee. 

Fernandez alleges that after consuming the coffee, he went into anaphylactic shock and required intubation and an extended hospital stay. He claims the coffee did contain nut allergens which caused his medical emergency. Fernandez alleges the defendant breached their implied warranty of merchantability that requires the product to be safe and that their negligence caused his personal injury. 

Fernandez seeks monetary relief, interest, trial by jury and all other just relief. He is represented by John Ford of Kenney & Conley PC in Braintree.
