Roofer claims defective materials caused his fall, spinal fractures

BOSTON (Legal Newsline) — A worker at a  job site in Massachusetts alleges defective roofing materials caused his fall and severe spinal injuries. 

Dale Sarno and Pamela Harritos filed a complaint Feb. 24 in Suffolk Superior Court against Jackson Lumber and Millwork Co., Inc., IKO Sales Inc., alleging negligence and other claims. 

Sarno, according to his complaint, was working at a home in Danvers on May 11, 2020. He alleges that as the work day progressed, it began to rain lightly, which caused the roofing material manufactured and sold by the defendants to become very slippery. Sarno claims he slipped off the roof and onto the ground below and suffered a spinal fracture and trauma to his arms, hip and other parts of his body that required him to be transported by ambulance to the nearest hospital. 

He alleges the roofing material was defective and that there was no warning about the hazard if the material became wet. He also alleges Jackson Lumber breached its warranties of the roofing materials because it was not safe and fit for the purpose intended. Sarno alleges as a result of his injuries he not only suffered debilitating injuries, but also lost wages and incurred medical expenses. 

Sarno seeks monetary relief, interest, trial by jury and all other just relief. He is represented by David McMorris and Leah McMorris of The Thornton Law Firm LLP in Boston.
