BROOKLYN, N.Y. (Legal Newsline) — A New York consumer has filed a class action against the makers of Kerrygold butter due to the products allegedly containing synthetic chemicals.
Carolyn Winans, individually and on behalf of all others similarly situated, filed a complaint Feb. 14 in the U.S. District Court for the Eastern District of New York against Ornua Foods North America Inc., alleging violation of the New York Deceptive Trade Practices Act, negligent misrepresentations and other claims.
Winans filed a class action alleging that the defendant's Kerrygold Salted and Unsalted Butter Sticks are falsely labeled as "Pure Irish Butter" even though they contain polyfluoralkyl (PFAS). She claims that the defendant used the false labeling of the butter product to drive sales and increase profits despite knowing it contains synthetic chemicals which are harmful to humans and the environment.
Winans further claims the defendant targeted health-conscious consumers with its false and misleading packaging and took no steps to disclose that the butter contained PFAS chemicals. She alleges she and class members have paid a premium for the butter due to the defendant's misrepresentations.
