NEW YORK (Legal Newsline) — A New York consumer has filed a class action lawsuit alleging Snyder's of Hanover pretzels are misleadingly labeled.
Taren Payne, individually and on behalf of all others similarly situated filed a complaint Feb. 13 in the U.S. District Court for the Southern District of New York against Campbell Soup Company and Snyder's-Lance Inc., alleging violation of state consumer protection statues and other claims.
The plaintiff alleges in her class action that the defendants' are misrepresenting that their Synder's of Hanover "Braided Twist Pretzels" are made with "whole grain" and that their "Honey Wheat" pretzels are made with "real honey." The plaintiff claims that they purchased the defendants' products at various grocery stores in New York and chose the products over comparable items due to the claims on the labels.
She also claims they paid a "substantial price premium" for the products based on the defendants' false and misleading labeling and marketing of the pretzels. The plaintiff alleges that the defendants' honey wheat product is primarily sweetened with brown sugar, tapioca syrup and malt extract. She further alleges the defendants' products labeled as whole grain when it is primarily made from enriched wheat flour.
The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. They are represented by Adrian Gucovschi of Gucovschi Rozenshteyn PLLC in New York.
