Consumers claims Fabuloso cleaner contains dangerous bacteria

WHITE PLAINS, N.Y. (Legal Newsline) — A consumer class action lawsuit alleges Fabuloso cleaning products contain dangerous bacteria.

Jeannie Patora, individually and on behalf of all others similarly situated, filed a complaint Feb. 9 in the U.S. District Court for the Southern District of New York against Colgate-Palmolive Co., alleging misleading business practices and other claims. 

Patora alleges in her class action that the defendant is deceptively and improperly labeling its Fabuloso cleaning products by failing to disclose on its packaging that consumption of the products may increase the risk of "invasive infections," especially for immunocompromised individuals. 

She claims the disinfecting products contain Pseudomonas aeruginosa, a gram-negative bacterium that can survive on inanimate surfaces for months. Patora further claims that she purchased the product that was subject to recall and was forced to spend money to clean and decontaminate her home. She alleges the Fabuloso label does not disclose or at risk for containing Pseudomonas aeruginosa either in its active and inactive ingredients list. 

Patora and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Jason Sultzer, Joseph Lipari and Daniel Markowitz of The Sultzer Law Group PC in Poughkeepsie, New York, as well as lawyers at Milberg Coleman.
