Boston restaurant faces wrongful death claim after choking death

BOSTON (Legal Newsline) — A Boston restaurant is facing a wrongful death lawsuit after a customer allegedly died from choking while dining there.

Elsilia Mejia, as personal representative of the Estate of Mauricio Mejia Maldonado filed a complaint Jan. 5 in Suffolk County Superior Court against Am Callejas LLC, doing business as La Hacienda Restaurant, and Am Callejas Realty LLC alleging wrongful death, negligence and other claims. 

According to the plaintiff's complaint, Mauricio Mejia Maldonado and a guest were at the La Hacienda Restaurant on Meridian Street in East Boston on Oct. 3, 2022. The plaintiff claims Maldonado choked on food while eating at the restaurant, was taken to Massachusetts General Hospital and died six days later. 

The plaintiff further claims the food served at the La Hacienda Restaurant was "defective and not reasonably suitable" and alleges the restaurant failed to provide food that was safe for consumption. The plaintiff alleges that the defendants' negligence and "reckless conduct" caused the "conscious suffering" and death of Maldonado.

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. The plaintiff is represented by Attorney Dino Tangredi in Watertown.
