School bus driver, employer face wrongful death claim after pedestrian's death

BOSTON (Legal Newsline) — The estate of person struck and killed by a school bus is claiming wrongful death and negligence against the driver and his employer.  

Alex Medina, personal representative of the Estate of Alexangeliz Medina filed a complaint Dec. 27 in Massachusetts' Suffolk County Superior Court against First Student and Pedro Padilla alleging wrongful death and negligence. 

According to the plaintiff's complaint, Alexangeliz Medina was walking at a marked crosswalk on State Street in Springfield on Dec. 8, 2021, and was struck and killed by a First Student bus that was being driven by Padilla. The plaintiff alleges the negligence of Padilla caused Medina's death and that she was in a conscious condition prior to her death and suffered physical pain and mental anguish. 

The plaintiff further alleges that First Student is liable for Padilla's negligence while he was under its employ as a bus driver. 

The plaintiff seeks monetary relief, interest and all other just relief. He is plaintiff is represented by Marc Breakstone of Breakstone, White, & Gluck PC in Boston.
