Suit: 'Keto Friendly' $10 per bag cereal does not contain promised ingredients

SAN FRANCISCO (Legal Newsline) — The maker of a premium-priced "keto friendly" cereal is facing a lawsuit alleging its packaging is misleading to consumers. 

Karen Collyer filed a complaint Jan.20 in the U.S. District Court for the Northern District of California against Catalina Snacks Inc., alleging violation of the California's Consumers Legal Remedies Act and other claims. 

Collyer alleges in her complaint that Catalina Snack products including "Catalina Crunch" cereal varieties are misleadingly labeled and do not contain the promised ingredients. She claims the labels on the products "lure" consumers with flavors such as "chocolate banana," "honey graham," "mint chocolate" and "apple cider donut" when they are not made with actual fruits or premium ingredients. 

Collyer further claims there is no banana, apple, honey or mint in the respective flavors and that they are falsely marketed as "keto friendly" and as being made with "real ingredients." She claims the cereal is sold for $7 to $10 for a nine-ounce bag and that consumers pay more for the cereal believing it is healthy.  

Collyer, who purchased the cereals in Monterey County during 2022, alleges she believed she was purchasing cereals that contained fruits and "premium ingredients" that are represented on the package. 

Collyer seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Benjamin Gubernick of Gubernick Law PLLC in Phoenix, Arizona.
