Ritz-Carlton employee sues, says he's owed money for time spent at security checks and other activities

SAN FRANCISCO (Legal Newsline) — A former California Ritz-Carlton employee is alleging the company practiced unlawful labor and payroll practices including requiring the use of personal cell phones for work-related duties. 

Bennie Dozier on behalf of himself and for all other current and former aggrieved employees, filed a complaint Dec. 2 in the San Francisco Superior court against The Ritz-Carlton Hotel Company LLC, alleging violation of California's Labor Code and other claims. 

Dozier, according to his complaint, was a restaurant host, bartender, pool worker and banquet employee at the Ritz-Carlton in Marina Del Rey for six years. He claims he was an hourly, non-exempt employee and that the Ritz-Carlton deprived him of his rights under California Labor Code. 

Specifically, Dozier claims he was not paid overtime for meeting time, training time, time spent at security checks, uniform changes, travel time and working/on-duty/interrupted meal time. He alleges the Ritz- Carlton did not provide employees with duty-free meal periods or duty-free rest periods, as well as all accrued and unused vacation wages including floating holidays, personal days and personal time. Dozier further alleges the Ritz-Carlton does not reimburse its employees for uniform expenses or cleaning expenses and required the use of private cell phones for work-related purposes. He claims the Ritz-Carlton also failed to pay him all the wages he was entitled to upon his termination. 

Dozier and the class seek monetary relief, interest, trial by jury and all other just relief. He is represented by Stanley Saltzman and Cody Kennedy of Marlin & Saltzman LLP in Agoura Hills.
