Suit: Costco's Kirkland brand laundry detergent does half as many loads as promised

BROOKLYN, N.Y. (Legal Newsline) — A New York woman claims in a class action that Costco's Kirkland brand laundry detergent is only sufficient for half as many loads as advertised on the product's label. 

Eukarys Medina, individually and on behalf of all others similarly situated, filed a complaint Dec. 6 in the U.S. District Court for the Eastern District of New York Brooklyn against Costco Wholesale Corporation alleging violation of state consumer fraud acts, breach of express warranties and other claims. 

Medina alleges in the class action that Costco's Kirkland Signature Ultra Clean brand laundry detergent is falsely marketed and labeled as sufficient for 146 loads of laundry. Specifically Medina claims that the detergent's front label stating "146 loads" is followed by a "difficult to-see asterisk" that on the reverse label states "146 loads when filled to slightly below line 4 on the cup." 

Medina further claims "line 4" is designated as "regular" size loads and should be "more accurately described as "small." Medina alleges that the majority of consumers will only be able to get 73 loads from the 5.73 liters of detergent. The plaintiff alleges that Costco's misleading representations result in the detergent being sold for a "premium price" of $20.59.

Medina seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Spencer Sheehan of Sheehan & Associates PC in Great Neck, New York, and James Chung of The James Chung Law Office in Bayside, New York.
