Eye drop user says maker is ripping him off

WHITE PLAINS, N.Y. (Legal Newsline) - A maker of eye drops faces a class action lawsuit that says customers get only 20 days' worth of product instead of the 30 promised on the packaging.

Clark Alexandre filed suit Oct. 17 in New York federal court against Alcon Laboratories, which manufactures Pataday-brand eye drops for allergy relief. Alexandre says he puts one drop in each eye every day, as directed.

"Over several months, Plaintiff observed that the bottles last approximately 20 days instead of the 30 promised on the label," the suit says.

He complained to Alcon, which sent him three replacement bottles that each lasted 20 days, he says. The lawsuit cites a ProPublica report from 2017 that said drug companies know "their eyedrops are wasteful."

"The investigation tells how in the early 1990s, Defendant's researchers developed a 'microdrop' which was able to deliver eye solution effectively and without waste," the suit says.

"However, this was never implemented, because doing so would sacrifice sales."

Alexandre is represented by Spencer Sheehan of Great Neck, N.Y.
