Roofer claims defective ladder sold by Home Depot caused his injuries

TAMPA, Fla. (Legal Newsline) — A roofer claims a defective ladder sold by Home Depot caused his fall and injuries at a job site in Brandon, Florida. 

Shawn P. Maxon filed a complaint  Oct. 10 in Hillsborough County Circuit Court against Home Depot USA Inc., doing business as The Home Depot, alleging liability and negligence. 

Maxon, according to his complaint, was working for a roof sales company at a job site in Brandon on Oct. 13, 2021. He claims that he was using a telescopic ladder purchased from Home Depot when the ladder's extended components suddenly failed and caused him to fall to the ground. 

Maxon alleges the ladder was defective in design, manufacturing and warnings. He further alleges Home Depot as the seller and distributor of the ladder had a duty to assemble, test, inspect and label the ladder with adequate warnings. He also alleges Home Depot had a duty to sell the ladder in a reasonably safe condition and should have known of the ladder's unreasonably dangerous condition. 

Maxon claims as a result of his fall, he suffered disability, impairment, disfigurement, lost wages and incurred substantial medical expenses. 

Maxon seeks monetary relief of more than $30,000, trial by jury and all other just relief. He is represented by Shane Newlands, William Clark and Jeremiah Fues of Newlands & Clark in Lakewood Ranch.
