CHICAGO (Legal Newsline) - A New York lawyer has filed a class action lawsuit because the markings on measuring cups tend to wear off when the cups go through the dishwasher.
Spencer Sheehan and client Tammy Devane sued Instant Brands on Sept. 10 in Chicago federal court over glass measuring cups sold under the Pyrex brand. They are marketed as "dishwasher safe," the suit says, despite the fact its ounce and cup lines disappear.
"The result is that it no longer can meet its intended purpose of measurement," the suit says.
The suit cites "hundreds of customer complaints," some of which complain the markings come off after an initial wash. Most comments say the fading occurs within several months, it says.
"Numerous reviewers describe how their older Pyrex cups lasted for years without any fading to the markings," the suit says. "The diminished permanence of the markings has occurred for at least three years."
A limited two-year warranty only provides replacements for cups that break from oven heat, the suit says.
