TRENTON, N.J. (Legal Newsline) - An unhappy customer is hoping to lead a class action lawsuit against Chick-fil-A over what she says are hidden fees on delivery orders.
Susan Ukpere sued the fast food chain on Aug. 1 in New Jersey Superior Court, and the defendant removed the case to federal court on Sept. 2. She says the company's promise to add a flat fee of $2.99 or $3.99 is false.
"On delivery orders only, Chick-fil-A secretly marks up food prices for delivery by a hefty 25-30%," the suit says.
"In other words, the identical order of a 30-count chicken nuggets costs approximately $5-6 more when ordered for delivery than when ordered via the same mobile app for pickup, or when ordered in-store."
Chick-fil-A's promise of free or low-cost delivery deceives customers into making delivery orders they otherwise would not make, the suit adds.
Several firms are pursuing the case, including Dapeer Law, Edelsberg Law and Shamis & Gentile.
