Law firm sues to take half of fees from CoQ-10 class action settlement

NEW YORK (Legal Newsline) - Class action lawyers are fighting over the fees from a seven-figure settlement with Walmart and other companies.

Canova Law Office says it is owed half of the more than $470,000 pocketed by The Law Office of Ronald A. Marron in a lawsuit filed Aug. 21 in New York federal court. The dispute stems from a class action against Walmart over a dietary supplement called CoQ-10 that also namedLang Pharma Nutrition, CVS, Walgreen and Meijer Distribution.

The suit said the supplements weren't as effective as advertised. The settlement created a fund for consumers worth more than $1.3 million.

It also generated $435,289.80 in fees, plus another $39,031.51 in costs. In 2019, that money was given to the Marron firm. The Canova firm said it performed substantial work on the case and had a 2017 agreement with Marron to take half of the fees from the case.

"Any and all conditions precedent have occurred or have been performed, and the Canova firm has duly performed all of its material obligations under the engagement letter," the lawsuit says. "(T)he Marron firm has breached its obligations under the engagement letter to the Canova firm."

The suit seeks at least $237,160.66, plus interest. Canova is represented by Andrew Saulitis.
