Containers of PlantFusion protein powder only half-filled, lawsuit complains

SAN FRANCISCO (Legal Newsline) - Packages of protein powder contain an illegal amount of empty space, a class action lawsuit against Reliance VItamin says.

Taylor Costa and her lawyers at Clarkson Law Firm sued the company Aug. 15 in California federal court, alleging violation of state consumer protection laws and fraud. The suit targets PlantFusion protein powder.

It says despite the container being nearly 22 centimeters, half of that is empty space - so-called "slack fill."

"Defendant markets the products in a systematically misleading manner by representing them as adequately filled when, in fact, they contain an unlawful amount of empty space..." the suit says.

"Defendant underfills the products for no lawful reason. The front of the products' packaging does not include any information that would reasonably apprise Plaintiff of the quantity of product relative to the size of the container, such as a fill line."
