Nespresso faces class action alleging customers forced to buy its coffee

NEW YORK (Legal Newsline) - Nespresso faces a class action lawsuit over a clause in its warranties that allegedly requires customers to buy its own coffee capsules.

The lawsuit filed Aug. 10 in New York federal court by plaintiff Abigail Shaughnessy alleges violations of the Magnuson-Moss Warranty Act and cites Federal Trade Commission guidance on warranties that "state or imply that a consumer must buy or use an item or service from a particular company to keep their warranty coverage."

Pursuing the case are attorneys at Bursor & Fisher. They say consumers have to buy Nespresso Vertuo-branded coffee capsules from Nespresso at inflated prices to keep their warranty coverage.

"(Shaughnessy) would have liked to use cheaper third-party coffee capsules, but her warranty, as written, implied that she was prohibited from doing so," the lawsuit says.

"Specifically, Defendant’s warranty states: 'This appliance is designed for Nespresso Vertuo coffee capsules available exclusively through the Nespresso Club or your Nespresso authorized representative.'”
