New Hampshire wants company to pay for cleanup of Davidson Rubber plant

CONCORD, N.H. (Legal Newsline) - The State of New Hampshire is going to court to seek costs associated with the cleanup at a former automobile parts plant in Farmington.

The state's Department of Environmental Services filed suit Aug. 12 against McCord Corp. under the federal Superfund law. The case concerns a former Davidson Rubber plant that McCord operated in the 1969s and 1970s.

"Specifically, McCord's manager of safety and ecology played a key role in decisions about waste management, environmental compliance and plant expansion at the site," the suit says. "Moreover, McCord denied and later approved the construction of certain wastewater treatment at the site."

The manufacturing process and plant design caused groundwater to be contaminated with volatile organic compounds like chromium, PFOA and PFOS, the suit says.

New Hampshire says it has incurred at least $166,000 in response costs that have not been reimbursed.
