LOS ANGELES (Legal Newsline) - Attorneys have targeted Goodyear for what they say is the unlawful collection of data from visitors to its website.
Pacific Trial Attorneys sued the company on Aug. 1 as part of a growing trend of litigation that argues "keystroke monitoring" software violates the California Invasion of Privacy Act. Arisha Byars is the named plaintiff in a proposed class action.
"Defendant has secretly deployed 'keystroke monitoring' software that Defendant uses to surreptitiously intercept, monitor and record the communications (including keystrokes and mouse clicks) of all visitors to its website," the suit says.
"Defendant neither informs visitors nor seeks their express of implied consent prior to this wiretapping."
The lawsuit seeks statutory damages under CIPA, as well as punitive damages and attorneys fees.
