SANTA ANA, Calif. (Legal Newsline) - Ambrosia Nutraceuticals faces a class action lawsuit that alleges its "gluten-free" marketing of Planta protein is deceptive.
J. Ryan Gustafson of Good Fustafson Aumais filed the case in California federal court on July 18 on behalf of plaintiff Evan Musa. They say despite a promise the protein doesn't contain gluten, it actually does.
"Now, instead of informing the public that it had previously deceived consumers by including a dangerous allergen, Defendant literally covers up the Gluten Free claim with a removable sticker without alerting retailers, consumers or regulators to its deception," the lawsuit says.
"Even worse, while the label is 'covered up,' Defendant continues to market the products as gluten free despite being alerted by numerous consumers that they've been harmed."
The suit says the ingredients list contains wheat flour. The company is capitalizing on the demand for gluten-free products, it adds, with studies showing consumers' willingness to pay more.
