SAN FRANCISCO (Legal Newsline) - The numbers don't add up on Similac Infant Formula, a new class action lawsuit says.
Plaintiff Callie Green sued Abbott Laboratories July 5 in California federal court. She says the bottles promised by the powder version of formula falls short.
While a 30.8 oz. label says it makes 59 4 oz. bottles, if one follows the mixing guide on the back label, only 53.23 bottles are produced, the suit says.
"On each package of Similac Powder Formula, Abbott claims the product makes a certain number of bottles of prepared formula," the suit says.
"These statements are false or misleading because—given the dilution instructions set forth on the back panel of each Similac Powder Formula—the number of bottles Abbott represents each product makes is not what each product actually makes when mixed with water according to Abbott’s own instructions, and thus the value is not what Abbott represents."
Lawyers at Fitzgerald Joseph in San Diego are pursuing the case.
