Fudge mint cookie maker hit with lawsuit that says there's no fudge or mint

ROCKFORD, Ill. (Legal Newsline) - Dollar General is one of the latest companies to face a class action lawsuit that alleges the fudge in its snacks is not real fudge.

Plaintiff Dawn Nastali filed suit June 19 in Illinois federal court against the company over its Clover Valley-brand Fudge Mint Cookies. She is represented by attorney Spencer Sheehan of New York.

The lawsuit goes back to 1893 to cite traditional recipes for fudge Sheehan says Dollar General failed to follow by not including milkfat. Vegetable oil is used instead.

"The ingredients do not disclose any dairy ingredients," the suit says. "The vegetable oil shortening is part of the 'fudge' component of the product because it would not be a part of a regular chocolate mint cookie."

Thus, reasonable consumers are misled, the suit says. It also finds fault with the mint label, as the ingredients list shows "natural and artificial flavor" and not mint.

"To the extent the product may taste like mint, this is from 'Natural and Artificial Flavor,' a synthesized blend of compounds extracted in a laboratory from natural and artificial sources, with no connection to mint ingredients," the suit says.
