SAN FRANCISCO (Legal Newsline) – The Beverly Hills law firm Brodsky & Smith has sued Select Sport America under California’s Proposition 65.
Companies that make products that contain chemicals listed on California’s Prop 65 list are required to include warning labels that say they could cause cancer. Some plaintiffs lawyers make millions filing lawsuits.
Plaintiff Ema Bell and lawyers filed suit May 18 in San Francisco Superior Court over the chemical di(2-ethylhexyl) phthalate (DEHP), which is allegedly found in Select’s athletic bags.
Prop 65 allows for civil penalties of up to $2,500 per violation. The suit says DEHP has been listed on the Prop 65 list since 2003.
“Defendant’s failure to warn consumers and other individuals in California of the health hazards associated with exposure to DEHP in conjunction with the sale and/or distribution of the products is a violation of Proposition 65 and subjects Defendant to the enjoinment and civil penalties…” the suit says.
The plaintiff sent a bag purchased a month earlier to a testing laboratory in December, the suit says.
