Lawsuit alleges dangerous chemical in eyeshadow

SAN FRANCISCO (Legal Newsline) – The San Diego law firm Entorno Law has sued Tarte, Inc., Kose America, Inc., Sephora USA under California’s Proposition 65.

Companies that make products that contain chemicals listed on California’s Prop 65 list are required to include warning labels that say they could cause cancer. Some plaintiffs lawyers make millions filing lawsuits.

Plaintiff Environmental Health Advocates and its lawyers filed suit May 23 in San Francisco Superior Court over the chemical Titanium Dioxide. They say it is found in eyeshadow products like the Tarte Power Bar.

Prop 65 allows for civil penalties of up to $2,500 per violation. The suit seeks a minimum of $1 million.

“Products expose individuals to TiO2 through direct inhalation,” the suit says. “This exposure is a natural and foreseeable consequence of Defendants placing Products into the stream of commerce. As such, Defendants intend that consumers will use Products, exposing them to TiO2.”
