SAN FRANCISCO (Legal Newsline) – A group dedicated to bringing litigation to enforce California’s notorious Proposition 65 has filed a lawsuit in San Francisco over a chemical known as DEHP.
Keep America Safe and Beautiful, represented by Kimberly Gates Johnson of Seven Hills LLP, on May 4 sued Trimark United East, Culinary Essentials and Chef’s Toys. The suit involves di(2-ethylhexyl) phthalate found in kitchen utensils.
Companies that make products that contain chemicals listed on California’s Prop 65 list are required to include warning labels that say they could cause cancer. Some plaintiffs lawyers make millions filing lawsuits.
The lawsuit against Trimark, Culinary Essentials and Chef’s Toys says their products with vinyl components contain DEHP.
“Plaintiff investigated and tested Defendants’ products at an accredited lab, and consulted with a person with relevant and appropriate knowledge and expertise, who, after reviewing the collected data and analyzing the risk of exposure to DEHP, determined the products subject consumers in California to exposure to the listed chemical at levels requiring a warning under the statute, based on touching, handling or otherwise utilizing products in accordance with their reasonably foreseeable and intended usages,” the suit says.
