Done with FTC, Fashion Nova faces class action lawyers over online reviews

DETROIT (Legal Newsline) - A clothing retailer for years suppressed lousy reviews, a class action lawsuit alleges.

Tanisha DiVito and her lawyers at Bursor & Fisher filed suit April 18 in Michigan federal court against Fashion Nova, piggybacking on Federal Trade Commission findings that say the company had four- and five-star reviews automatically posted on its site but prevented hundreds of thousands of lower-starred reviews from becoming public.

DiVito says she relied on the reviews on the site when deciding to purchase items at certain prices and seeks compensation for allegedly being lied to.

"Had Defendant not engaged in these deceptive and unfair practices, the average ratings and inherent value to prospective consumers of Defendant's products would have been lower," the suit says.

"Moreover, the written reviews would have provided more information to prospective consumers, including concerns over the quality of the products, prior to deciding to purchase said products."

Fashion Nova paid $4.2 million to settle in January with the FTC.
