Customer sues to get refund on cancelled flight during onset of pandemic

SAN FRANCISCO (Legal Newsline) – Philippine Airlines faces a recently filed class action lawsuit claiming it ripped customers off during the COVID-19 pandemic.

Gemnaika Flores filed the case through lawyers at Bursor & Fisher on April 12 in California federal court. The case says Philippine Airlines failed to provide full refunds to customers whose flights were cancelled or subject to a significant schedule change.

The suit says PAL cancelled a vast percentage of its international and U.S. flights.

“PAL’s inexplicable and continuous withholding of passengers’ refunds stands in direct contravention of their contract of carriage as well as other representations made to passengers…” the suit says.

The suit says Flores bought two roundtrip tickets for an April trip from San Francisco to Manila for $1,356.08. When she realized it would be difficult to reschedule the trip because of the pandemic, she tried to secure a refund, the suit says.

Emails and phone calls over several months did not result in a refund, the suit says.
