CONCORD, N.H. (Legal Newsline) - The Conservation Law Foundation is suing two companies, claiming problems with the water quality in the Merrimack River in New Hampshire.
CLF sued Nylon Corporation of America (NYCOA) and Wembly Enterprises on April 4 in New Hampshire federal court in a citizen suit brought under the Clean Water Act. The companies, collectively known as Nylon, are violating stormwater and wastewater permits, the suit says.
The site at issue is a nylon-production facility in Manchester that NYCOA has owned since at least 1994, the suit says.
CLF says the river's pH level has fluctuated outside of the levels required by the permits, as has its temperature. In January 2017, the company reported more than the maximum allowed chlorine, CLF says.
CLF has failed to file discharge monitoring reports, the suit says, and zinc levels have been a constant issue.
