Lawsuit blames restaurant for 'severe vomiting' after triple bacon cheeseburger

BENTONVILLE, Ark. (Legal Newsline) - An Arkansas restaurant faces a lawsuit after a customer who ate a triple bacon cheeseburger says it made him sick.

Robert John Mahmens seeks to hold the Cotton Patch Cafe liable for "severe vomiting" that lasted four days. He sued the restaurant March 1 in Benton County Circuit Court.

According to the suit, in May 2019, he was part of a party of four and had not eaten anything for 20 hours leading up to his meal. At 4 a.m. the next day, he says he began vomiting and had chills.

Eventually he went to the emergency room at Ozark Community Hospital, where he was administered fluids and prescribed anti-nausea medications.

"Plaintiff now suffers from a permanent intolerance to certain foods and drinks as a result of the sickness that was caused by the incident," the lawsuit says.

His wife is also suing for loss of consortium. Mahmens says he suffered emotional distress and medical-related expenses.
