BOSTON (Legal Newsline) - A daughter is suing the Massachusetts Bay Transportation Authority after her dad was hit by a bus in Dorchester, Mass.
The Jan. 21 wrongful death lawsuit is brought by Karen Fonseca on behalf of the Estate of Richard Ball, who died in 2020 after suffering traumatic brain injuries in the accident six months earlier.
The suit says on Dec. 10, 2019, Ball was crossing the street when an MBTA bus made a left turn to enter the Ashmont MBTA station and struck him in the crosswalk. In addition to the brain injuries, Ball suffered fractured ribs and a collapsed lung, the suit says.
He was hospitalized at Boston Medical Center for two months until sedation was weaned and he regained consciousness, the suit says. It adds he was severely cognitively impaired.
He went to a rehabilitation hospital after BMC then a nursing home, where he died as a result of his injuries in May 2020, the suit says.
The bus driver pleaded guilty to negligent motor vehicle homicide, the suit says. It was filed by Shawn O'Rourke of O'Rourke & Hawk in Charlestown.
