City of New York sued over ordinance that requires customers' data from delivery services

NEW YORK (Legal Newsline) - Portier LLC filed a federal lawsuit on Dec. 3 in the Southern District of New York against the City of New York for ordering food-delivery services to turn over customers' information.

According to the lawsuit, New York City enacted an unprecedented ordinance compelling Uber Eats, Postmates and other third-party food-ordering and delivery platforms to turn over private, commercially valuable and sensitive user data to local restaurants while providing virtually no protections for that data and no compensation for its value. 

The data that Uber Eats and Postmates will be compelled to provide includes each user’s name, phone number, email address, street address and the contents of each order, the suit says. The ordinance violates the rights and privacy of users who choose to use these delivery services, the suit says.

Portier LLC sees for the court to declare the ordinance as unlawful and is represented by Roberta A. Kaplan.
