Lawsuit alleges assault at NYC school

NEW YORK (Legal Newsline) - A mother has filed a lawsuit against the New York City Department of Education, claiming her child was assaulted by school staff.

Nicole Westley filed her case Jan. 10 in New York County Supreme Court, also naming Lucrecia Passade and Emma Chyniere as defendants. The alleged incident took place in January 2021 at Samuel Stern School on East 120th St.

The suit says the student was "physically assaulted, battered, confronted, touched, shoved, struck and otherwise physically abused" by Passade.

Three days later, the child was assaulted by Chyniere, the suit claims. It says the student has suffered personal injury.

Westley and her child are represented by David Harrison of Brooklyn.
