Toxic baby food lawsuit filed against Walmart

LITTLE ROCK, Ark. (Legal Newsline) - Walmart has been sued over possibly toxic materials in baby food.

Tyler Baker, individually and on behalf of all others similarly situated, filed a federal class action complaint on August 31 in the Eastern District of Arkansas against Walmart, Inc. for breach of express warranty, breach of implied warranty, unjust enrichment, violation of the Vermont Consumer Protection Act and violation of the Kentucky Consumer Protection Act.

According to the complaint, on February 4, 2021, the Subcommittee on Economic and Consumer Policy of the U.S. House of Representatives released a report concluding certain baby food manufacturers, including Walmart, sold products containing concentrations of inorganic arsenic, lead, cadmium, and mercury at levels above what is considered safe for babies. What followed was a pile of litigation against baby food makers.

Walmart does not disclose the toxic heavy metal content of its foods on its labels or in its marketing materials, nor does it warn consumers that its baby food products may contain potentially dangerous levels of toxic heavy metals, the suit says. The plaintiff allegedly purchased baby food products manufactured and sold by Walmart, unaware that Walmart products potentially contain toxic heavy metals at levels well above what is considered safe for babies, the suit says. 

Baker seeks the court to order Walmart to stop selling the baby food products that are unsafe, damages, pre-judgement interest, restitution, attorney's fees and cost of suit. Baker is represented by Stephanie Egner Smith.
