Attorneys have to go to court in dispute over settlement funds

FLORENCE, S.C. (Legal Newsline) - The law firm Wright, Worley, Pope, Ekster & Moss filed a federal complaint on July 21 in South Carolina against Sherry Ann Smith and Blue Cross Blue Shield of Tennessee.

According to the complaint, the Wright firm represented Smith in a lawsuit that was resolved via mediation. BCBST has asserted the first-priority right of subrogation and reimbursement over the settlement funds in the amount of $7,199.35. 

Smith disputed the subrogation lien and instructed the Wright firm not to pay it, the suit claims. The attorneys claim those settlement funds should be given to them.
