NEW YORK (Legal Newsline) -- A New York couple are suing after the sale of property fell through due to alleged malpractice of attorneys.
Ravinder Thota and Yashodhara Thota, owners of JSNM Shenango Valley Mall, LLC, filed a complaint on July 6 in New York County Supreme Court against David Giles, Lauren McKenna, Daniel Schnapp, Richard Holzowrth, Oksana Wright and Fox Rothschild for malpractice and negligence.
According to the complaint, the Thotas hired the defendants as attorneys to represent them for a case that was initially pending in Pennsylvania federal court.
In that case, Iowa Square was suing the Thotas as guarantors of certain real estate loans for real property located in Pennsylvania that had originally been made by Paradigm Credit Corporation.
The Thotas and their company JSMN signed a contract to sell the real property to Igal Namdar, the owner of Iowa Square Realty, LLC. After Paradigm Credit Corporation found out about the proposed contract, it allegedly went behind the plaintiffs' backs and agreed to assign/sell the loans to Namdar and Iowa Square Realty.
The Thotas allege that it is the result of the malpractice and negligence of the attorneys hired in that case that the sale fell through.
The Thotas seek compensatory damages, incidental damages, attorney's fees and cost of suit. The Thotas are represented by Vivek Suri.
