Arkansas nursing home hit with COVID wrongful death lawsuit

MARION, Ark. (Legal Newsline) -- A woman is suing a nursing home after it allegedly caused her father's death.

Malaika Rogers, natural daughter and personal representative of Ezzo Moore, deceased, filed a complaint on July 1 in the Circuit Court of Crittenden County against West Memphis Wellness LLC d/b/a The Springs Broadway and John Does 1-6 for wrongful death and negligence. 

According to the complaint, Moore was a resident of The Springs Broadway nursing home beginning April 2018. On July 1, 2019, Moore sustained injuries from several decubitus ulcers due to the alleged negligence of the facility. 

Moore was admitted to Baptist Main Hospital Memphis and was diagnosed with sepsis and required three weeks care in the hospital, the suit says. Moore was then released back to The Springs Broadway, but had to be brought back to Baptist Main Hospital Memphis on Feb. 1, 2020 for a two-week stay to relieve the decubitus ulcers, the suit says. 

On June 1, 2020, while in The Springs Broadway, Moore was exposed to and allegedly allowed to contract COVID-19, and then passed away on July 3, 2020, the suit says. Rogers alleged that it is because of the nursing facility's negligence that her father became sick multiple times, compromising his immune system.

Rogers seeks general and special damages, cost of litigation and further relief. Rogers is represented by Jose M. Bautista of Bautista Leroy LLC.
