Trucker's estate sues after fatal wreck, says she wasn't properly trained

WALDRON, Ark. (Legal Newsline) -- An Arkansas woman's estate is suing a trucking company and many other defendants for her death after a traffic accident.

Dawn Boyd, the special administrator of the estate of Taylor Tharp, filed a complaint on June 16 in the Circuit Court of Scott County against Kenworth Truck Company, PACCAR Leasing Company, PACCAR Machinery Company, Arkansas Kenworth Inc., Ozark Kenworth, Inc., Texas Kenworth Co., Specialty Bristow Sales, Murphy-Hoffman Company, Western Arkansas Consulting and Health Care Education Services and Vincent Trotter for products liability, negligence and breach of implied warranty. 

According to the complaint, on June 17, 2018, Taylor Tharp was instructed by Quick Construction and/or Quick-Lay to transport hazardous material driving a 2015 white Kenworth Truck. 

While driving on Highway 3, Tharp allegedly departed the roadway to the right, tried to correct, and re-entered the roadway, crossing the center line and departed the roadway to the left. The truck then allegedly rolled two-and-a-half times, ejecting Tharp from the truck. 

She was pronounced dead while en route to the hospital. Dawn Boyd alleges that Kenworth is responsible for the wrongful death or Tharp because Tharp was not properly trained and did not hold the proper CDL for transporting hazardous waste. 

Boyd seeks compensatory damages, attorney's fees and cost of suit. Boyd is represented by A. Powell Sanders of Sexton and Sanders Law Firm, P.A.
